Dispositivi sessuali. Il diritto alla prova del sesso artificiale

Realdoll e sexbot costituiscono la nuova frontiera del sesso tecnologico. I sexbot (robot sessuali), in particolare, oltre a replicare in maniera realistica le caratteristiche fisiche dell’essere umano, sono dotati di un sofisticato dispositivo di intelligenza artificiale che li mette in grado di eseguire funzioni evolute come condurre una conversazione a sfondo sessuale, riconoscere mediante telecamere inserite negli occhi il proprio partner e, addirittura, assumere diverse personalità (oltre che diverse sembianze) a seconda delle preferenze del suo utilizzatore. Il dato più rilevante è che simili dispositivi si stanno rapidamente diffondendo in molti paesi, europei e non. Di conseguenza, il fenomeno è destinato a sollevare parecchi interrogativi. Tolti gli psicologi, che sono già da qualche tempo al lavoro sul loro terreno, la parola sembra spettare soprattutto a coloro che si occupano di etica (o meglio: roboetica). Coloro che si occupano di diritto non sembrano invece ancora avvertiti del problema o sembrano ritenere che non sia ancora arrivato il momento di occuparsene. È assunto fondamentale di questo saggio che il momento non solo sia arrivato, ma che sia necessario avviare fin d’ora una discussione per evitare che, come è già accaduto fin troppo spesso con le nuove tecnologie, la crescita esponenziale del fenomeno colga il diritto impreparato. Il secondo assunto è che il compito del giurista, in relazione a questo che appare sempre di più come un futuro già cominciato, non è quello di adagiarsi sulle certezze del diritto positivo, ma di ipotizzare gli eventuali scenari che potrebbero mettere in crisi tali certezze e di immaginare, fin dove possibile, le possibili soluzioni. Gli scenari delineati in questo saggio si concentrano in particolare su a) il possibile uso illegittimo dei dati eventualmente acquisiti attraverso i dispositivi di cui il sexbot è dotato; b) le problematiche connesse con la produzione di sexbot con le sembianze fisiche di persone reali, soprattutto nel caso in cui c) la persona riprodotta sia un minore; d) le ricadute in termini di politica criminale nei confronti delle categorie dei sex offender; e) l’impatto del fenomeno sulla materia civilistica del diritto di famiglia e f) del diritto risarcitorio, e g) gli influssi negativi sull’immagine sociale della donna. Il paragrafo finale, aggiunto come poscritto dopo il verificarsi dell’epidemia da coronavirus, espone alcune riflessioni sugli effetti che le misure adottate dai vari governi per fronteggiare l’emergenza hanno avuto nell’incrementare l’utilizzo di dispositivi tecnologici per finalità sessuali.

Realdoll and sexbot constitute the new frontier of technological sex. Sexbots (sexual robots), in particular, in addition to realistically replicating the physical features of the human being, are equipped with a sophisticated artificial intelligence device that enables them to perform advanced functions such as conducting a conversation with a sexual background, recognize their partner through cameras inserted into the eyes and even assume different personalities (as well as different appearances) according to the preferences of its user. What is most relevant is that such devices are rapidly spreading in many countries, European and non-European. Consequently, the phenomenon is bound to raise several questions. Apart from the psychologists, who have already been working on the subject, it seems that it is mainly up to the ethics (i.e. roboetics) scholars to deal with the issue. On the other hand, legal scholars do not seem to have so far been warned of the problem or seem to believe that the time has not yet come to deal with it. It is a fundamental assumption of this essay that the time has not only arrived, but that it is necessary to start a discussion right now to avoid that, as has already happened all too often with new technologies, the exponential growth of the phenomenon seizes the law unprepared. The second assumption is that the jurist’s task, in relation to what appears more and more like a future that has already begun, is not to rest on the certainties of positive law, but to hypothesize prospective scenarios that could undermine such certainties and to imagine, as far as possible, possible solutions. The scenarios outlined in this essay focus in particular on a) the possible illegitimate use of data acquired through the devices the sexbot is equipped with; b) the problems connected with the production of sexbots with the physical features of real people, especially if c) the reproduced person is a minor; d) the repercussions in terms of criminal policy towards the categories of sex offenders; e) the impact of the phenomenon on the family law and f) on the right to compensation, and g) the negative influences on the social image of women. The final section, added as a postscript after the occurrence of the coronavirus epidemic, sets out some reflections on the effects that the measures adopted by the various governments to deal with the emergency have had in increasing the use of technological devices for sexual purposes.
